Terms of Service

Important service limitations

  • Telvio does not support emergency calls. You cannot reach 911, 112, 999, 000 or any other emergency number through Telvio. Telvio does not transmit your location to emergency responders.
  • Telvio is for outgoing calls only. It does not assign you a phone number and cannot receive incoming calls or text messages.
  • Telvio is not a replacement for your telephone service. Always keep a mobile or landline that can reach emergency services.

1. Who we are

Telvio is a mobile VoIP application provided by Vast Flow, LLP (“Telvio”, “we”, “us”). These Terms of Service (the “Terms”) form an agreement between you and Vast Flow, LLP. You can reach us at [email protected].

2. Acceptance and eligibility

By downloading, installing or using Telvio, you agree to these Terms. If you do not agree, do not use the app.

  • You must be at least 13 years old to use Telvio. If you are under the age of majority where you live, you may use Telvio only with the involvement of a parent or guardian, who accepts these Terms on your behalf.
  • You must be legally able to enter into a binding contract and to make purchases through your app store account.

3. What the service is — and what it is not

Telvio places outgoing voice calls to landline and mobile telephone numbers over an internet connection (WiFi or mobile data). The person you call answers an ordinary phone and needs no app.

The following limitations are fundamental to the service. Read them before you buy anything.

3.1 No emergency calling

Telvio does not provide access to emergency services and must never be relied upon to reach them. Calls to emergency numbers — including 911 (North America), 112 (EU and much of the world), 999 (UK), 000 (Australia) and every national or local equivalent — will not connect. Telvio does not route calls to Public Safety Answering Points, does not transmit your physical location or a callback number to emergency responders, and cannot substitute for a traditional or mobile telephone service in an emergency.

You are responsible for maintaining an alternative means of contacting emergency services. If your internet connection fails, your device loses power, or your credit runs out, Telvio will not work at all. You acknowledge this limitation and, to the fullest extent permitted by law, you waive any claim against us arising from an inability to reach emergency services through Telvio.

3.2 Outgoing only — no phone number

Telvio does not assign you a telephone number. You cannot receive incoming calls, text messages, or voicemail through the app. The number displayed to the person you call is determined by the carrier route used and may appear as an unfamiliar, international, or withheld number, which means your call may be screened or blocked by the recipient's device or carrier. We do not guarantee any particular caller ID.

3.3 Dependent on your internet connection

Call quality and call completion depend on your internet connection and on networks we do not control. Telvio does not guarantee that any call will connect, stay connected, or achieve any particular audio quality. Your mobile data plan may charge you for data used by the app; that is between you and your carrier.

4. Credit, rates and billing

  • Free minute. Every new installation includes one free minute. It is limited to one per user or device and may be withheld where we detect abuse.
  • Credit, not minutes. Packs ($1.99, $4.99, $9.99) are purchased as consumable in-app purchases and add a USD credit balance to your installation. They are not a fixed pool of minutes. Credit is spent at the per-minute rate of whatever destination you dial.
  • Rates vary by destination and differ between landline and mobile numbers, from $0.02 per minute upward. The app displays the applicable rate for a number before the call connects, and current rates are published on our rates page.
  • Per-second billing. Calls are charged for their actual duration in seconds, with no connection fee.
  • Credit does not expire and is not subject to inactivity fees.
  • Credit has no cash value. It cannot be exchanged for money, transferred between users or devices, or resold.
  • Rates may change. Our own carrier costs move, and we may adjust published rates. Changes apply only to calls placed after the change, never retroactively to calls you have already made.

Because credit is tied to your installation and we do not operate user accounts, uninstalling the app or resetting your device may permanently forfeit any unused credit. Contact us before you do so if you have a balance you care about.

5. Purchases and refunds

All purchases are processed by Apple (App Store) or Google (Google Play). We never receive or store your payment card details.

Refunds for App Store purchases are handled by Apple, not by us. We cannot issue, approve or deny a refund for a purchase made through the App Store. To request one, use Apple's process at reportaproblem.apple.com. Purchases made through Google Play are subject to Google Play's refund policy. Nothing in this section limits any statutory right of withdrawal or refund you may have under the consumer law of your country.

Consumed credit — that is, calls already placed — is not refundable except where the law requires it.

6. Acceptable use

You agree not to use Telvio to:

  • break any law, or place calls that are illegal where you are or where the recipient is;
  • make automated, bulk, robotic, auto-dialled or pre-recorded calls, or conduct telemarketing;
  • harass, threaten, defraud, impersonate, abuse or stalk anyone, or make hoax or nuisance calls;
  • resell, rebill, or provide the service to third parties, or use it as a gateway, trunk or termination point for other traffic;
  • dial premium-rate, revenue-share, or artificially-inflated-traffic numbers, or generate calls whose purpose is to earn termination revenue;
  • reverse engineer, decompile, tamper with, or attempt to circumvent the billing, rating or security of the app;
  • use the service in a way that harms our carriers, our network, or other users.

We may suspend or terminate access immediately, without notice and without refund of consumed credit, where we reasonably suspect fraud, abuse, or a breach of this section. Where we suspend an account for suspected fraud and the suspicion proves unfounded, we will restore your unused credit.

7. Your legal responsibility for calls

You are responsible for how you use Telvio.

  • Local legality of VoIP. Some countries restrict, license or prohibit VoIP calling. It is your responsibility to know whether using Telvio is lawful where you are, and to stop if it is not.
  • Call recording. Telvio does not record calls. If you record a call by any other means, consent laws in your jurisdiction and the recipient's are your responsibility.
  • Consent to be called. You are responsible for having any consent required to call the person you dial.

8. Sanctions and export compliance

Telvio may not be used in, or for calls to, jurisdictions subject to comprehensive trade sanctions, and certain destinations are unavailable for this reason. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree not to use Telvio in violation of any applicable export control or sanctions law.

9. Intellectual property

Telvio, its software, name, logo and content are owned by Vast Flow, LLP and protected by law. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose. You get no other rights.

10. Disclaimer of warranties

To the fullest extent permitted by law, Telvio is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any call will connect. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive or exemplary damages, or for lost profits, lost business, lost data, or missed communications, arising from your use of or inability to use Telvio — including dropped calls, failed connections, audio quality, and any inability to reach any number.

Our total aggregate liability arising out of or relating to Telvio is limited to the greater of (a) the amount you paid us for credit in the twelve months before the event giving rise to the claim, or (b) your unused credit balance.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer in the EEA or the UK, you keep all mandatory statutory rights, and these limits apply only so far as the law allows.

12. Indemnity

You agree to indemnify and hold Vast Flow, LLP harmless from claims, damages and reasonable costs arising from your breach of these Terms, your misuse of the service, or your violation of the rights of anyone else.

13. Suspension, termination and changes to the service

You may stop using Telvio at any time by deleting the app. We may modify, suspend or discontinue the service, in whole or in part. If we discontinue the service entirely, we will make a reasonable effort to give notice in the app and to refund unused credit where we are lawfully able to do so.

14. Changes to these Terms

We may update these Terms. We will change the “last updated” date above, and for material changes we will give notice in the app before they take effect. Continued use after a change takes effect means you accept the revised Terms. If you do not accept them, stop using Telvio.

15. Governing law

These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-law rules, and the courts of the Republic of Kazakhstan have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of your country of residence, or of the right to bring proceedings in your local courts where the law gives you that right.

16. Apple App Store — additional terms

These terms apply to the version of Telvio you obtained from the Apple App Store, and prevail over any conflicting term above in relation to that version.

  • This agreement is with us, not Apple. These Terms are concluded between you and Vast Flow, LLP only, and not with Apple Inc. We, not Apple, are solely responsible for Telvio and its content.
  • Scope of licence. Your licence to use Telvio is non-transferable and limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Telvio may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
  • Maintenance and support. We are solely responsible for providing maintenance and support for Telvio. Apple has no obligation whatsoever to furnish any maintenance or support services.
  • Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Telvio fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Telvio, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are our sole responsibility.
  • Product claims. We, not Apple, are responsible for addressing any claims relating to Telvio or your possession and use of it, including product liability claims, any claim that Telvio fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
  • Intellectual property claims. In the event of any third-party claim that Telvio or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
  • Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Third-party terms. You must comply with applicable third-party terms of agreement when using Telvio.
  • Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
  • Questions and complaints. Direct any questions, complaints or claims regarding Telvio to Vast Flow, LLP at [email protected].

17. General

If any provision of these Terms is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor in connection with a merger, acquisition or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding Telvio.
